Client Responsibilities

To ensure timely filing, clients are responsible for providing accurate and complete information regarding:

  • Ownership of the mark

  • Current or intended use of the mark

  • Goods and services associated with the mark

  • Requested specimens, logos, or supporting documentation

  • Any known third-party use of similar marks

Delays in providing requested information may affect filing timelines.

Unless specifically stated in a separate engagement agreement, this package does not include:

  • USPTO filing fees

  • Office Action responses

  • Supplemental trademark searches or legal opinions

  • Trademark monitoring services

  • Cease and desist letters

  • Trademark enforcement or infringement matters

  • Opposition or cancellation proceedings

USPTO filing fees apply to each additional class.

Important Pricing Information

USPTO filing fees are not included in the prices above and are paid separately to the USPTO.

As of 2026, USPTO filing fees generally begin at $350 per class.

A trademark class is a category of goods or services. For example, clothing, business consulting services, and software are generally different classes. Our filing package includes one class. Additional classes may require additional legal fees and USPTO filing fees.

Trademark registration is not guaranteed. The USPTO ultimately determines whether an application will be approved.

Estimated Turnaround Time

Application preparation is typically completed within 4 weeks after receipt of all required information and documentation.

Important Disclaimer

The USPTO ultimately determines whether a trademark application will be approved. While we conduct a trademark clearance review and prepare the application based on the information available at the time of filing, no attorney can guarantee registration, approval, or exclusive rights to a particular mark.

Our trademark search and filing services are intended to identify potential issues and improve the likelihood of a successful application; however, no search can identify every possible conflict, and previously unknown third-party rights may exist.

A trademark registration does not automatically prevent others from using similar marks, nor does it guarantee future protection against infringement, challenges, opposition proceedings, cancellation proceedings, or competing claims. Trademark owners are generally responsible for monitoring, maintaining, and enforcing their trademark rights.

Office Actions are not included. Approximately half of trademark applications receive some form of USPTO Office Action requiring additional legal analysis or response. If an Office Action is issued, we will provide a separate quote for further representation.

Ongoing trademark monitoring, enforcement, maintenance, renewal, and brand protection services are not included in this package but may be available through a separate engagement.
